This year, we are have three opportunities to win!
Age and legal eligibility. Federal law: 21+ for handguns, 18+ for rifles/shotguns. The winner must be legally allowed to possess the firearm under federal law and the law of the state where they take possession. Prohibited persons (felony conviction, certain domestic-violence misdemeanors, unlawful drug user, fugitive, etc.) cannot take the prize. Texas License to Carry holders can often skip the NICS check at transfer, but they still complete Form 4473.
Transfer process. The winner does not walk away with the gun at the drawing. Transfer must go through a licensed FFL. Typical process: winner appears at the designated dealer, completes ATF Form 4473, and the dealer runs NICS (or accepts a qualifying Texas LTC). The Post should not take possession of the firearm if it can avoid it.
If the winner cannot take the gun. If they fail the background check, are a prohibited person, do not complete the transfer by the deadline, or refuse the prize, they forfeit and the ticket will be redrawn.
Fees and taxes. Winner pays all FFL transfer fees, any shipping if they use an out-of-area dealer, and any applicable taxes. The fair-market value of the prize is taxable income to the winner. The Post may have IRS reporting/withholding duties (W-2G or 1099 depending on value and thresholds).
Prize is not transferable. Only the person named on the winning ticket can claim it. Tickets should not be issued in a minor’s name.
Attestation. By buying a ticket the purchaser represents they are a U.S. resident (or can legally receive an interstate FFL transfer), of good character, legally able to possess the firearm, and will use it only lawfully.
Liability limit. The Post’s liability is limited to the ticket price. All federal, state, and local firearm laws apply. Void where prohibited.
